The Competition Bureau of Canada has specific guidance on "ordinary selling price" representations. Under the Competition Act (sections 74.01(2) and (3)), retailers cannot advertise savings against a regular price unless that price reflects what a substantial volume of the product was actually sold at, or was genuinely offered for sale at that price for a reasonable period. Whether Nectar's Canadian pricing meets this standard is worth considering when evaluating their "discount."

Nectar also settled with the US Federal Trade Commission for $753,000 over "Made in USA" claims. The FTC found that Nectar mattresses were not manufactured in the United States as advertised. This settlement is public record and was announced by the FTC in 2021. For Canadian buyers, "where is this made?" is a reasonable question. The current answer appears to be a mix of domestic and overseas manufacturing.

• Stains, burns, or physical damage
